§ 1 Provider & Scope of Application

These Terms and Conditions apply to all orders placed through the online store dreamz-tcg.de by consumers in accordance with Section 13 of the German Civil Code (BGB). Any conflicting terms and conditions provided by the customer will not be recognized unless the seller agrees to them in writing.
§ 2 Conclusion of the Contract
The presentation of products in the online store does not constitute a binding offer, but rather an invitation to place an order (invitatio ad offerendum). By clicking the “Buy Now” button, the customer submits a binding offer (Section 312j(3) of the German Civil Code (BGB)). The seller will confirm receipt of the order via email. This confirmation does not constitute acceptance. The contract is not concluded until the goods are shipped.
§ 3 Prices & Shipping Costs
All prices are final prices in accordance with the Price Indication Regulation. The seller qualifies for the small business exemption (§ 19 UStG) — no sales tax is shown. Shipping costs are clearly displayed during the ordering process.
§ 4 Payment
Accepted payment methods are displayed at checkout (e.g., PayPal, bank transfer, Klarna—depending on the setup). If you pay in advance, the amount is due immediately.
§ 5 Delivery
Delivery typically takes 2–5 business days, unless otherwise specified. In the case of the sale of consumer goods, the risk passes to the customer only upon delivery of the goods (Section 475(2) of the German Civil Code (BGB)).
§ 6 Right of Withdrawal
Consumers have a statutory right of withdrawal in accordance with Sections 312g and 355 of the German Civil Code (BGB). The complete withdrawal policy is provided separately (on a dedicated page in the store). Note: Opened TCG booster packs/displays are goods that have lost value; therefore, the right of withdrawal may be excluded if the seal has been broken (Section 312g(2)(3) of the German Civil Code (BGB)). § 7 Retention of Title
Until full payment has been made, the goods remain the property of the seller (Section 449 of the German Civil Code (BGB)).
§ 8 Warranty
The statutory warranty rights apply (Sections 434 et seq. of the German Civil Code (BGB)). TCG single cards are collectibles; minor variations in condition (e.g., Near Mint / Light Play) are clearly described in the store and are not considered defects, provided they match the description.
§ 9 Liability
The Provider is liable only for willful misconduct and gross negligence. In cases of slight negligence, the Provider is liable only for damages resulting from a breach of material contractual obligations (cardinal obligations). Liability for damages resulting from injury to life, body, or health remains unaffected.
§ 10 Dispute Resolution
The provider is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Contract Language & Storage
The language of the contract is German. The text of the contract is stored by the provider and can be sent to the customer upon request.
